The US Supreme Court of the 1960s and ’70s is typically regarded as an ally of the sexual revolution. But Stein, an associate professor of history, women’s studies, and sexuality studies at York University in Toronto, argues against this view. Drawing on a close reading of the 1967 case Boutilier, he shows that the same court that issued liberal rulings on birth control, abortion, interracial marriage, and obscenity also upheld an immigration statute that labeled gays as having “psychopathic personalities,” thus leading to their potential deportation and exclusion from the country.
